An electronic POS system is not generally mandatory in Germany.
However, once an electronic cash register or digital POS system is used, the legal requirements of the Cash Register Security Ordinance (KassenSichV) apply. Since January 1, 2020, it requires electronic POS systems to be equipped with a certified Technical Security Device (TSE) to prevent manipulation.
Businesses that continue to use an open cash register are exempt from the TSE requirement. However, they must ensure proper, complete, and traceable cash management, including daily cash reports and cash counts. Open cash registers are also subject to increased scrutiny by the tax authorities.
Companies with high cash volumes – such as retail, hospitality, or service businesses – benefit in particular from a modern POS system. Business transactions are fully documented, archived in compliance with regulations, and audits are significantly simplified. Violations of legal requirements can lead to substantial tax consequences and back payments.
